Pre-deposition and pre-trial counseling of your physician, nursing, and extender staff - Dr. Schultz will work with your doctor and medical support staff defendants and defense team to help enhance the defendant's performance at deposition and/or trial. We will review the case, help in medical strategy formulation, discuss deposition/trial testimony skills and pitfalls, address areas of weakness, and have the defendant practice testimony delivery. My first and foremost role is to help the insured understand litigation from a doctor’s and plaintiff’s perspective. I attempt to help the insured deal with the emotional baggage he/she brings to the litigation which invariably prevents them from becoming a good witness. They often start out as a liability for the defense; my job is to teach them how to become an asset for the defense. I have instant credibility with the healthcare insureds. They trust me and realize I have no hidden agendas. I can also be very frank with them while defense counsel remains neutral. In other words, I can be the “bad cop” without any loss of credibility. I must emphasize that I consider myself a medical-legal strategist in addition to a witness coach. I’m very case oriented and often help the attorney develop the defense strategy, recommend experts, etc. I frequently will find defenses that everyone has failed to discover including all the experts. I look at these cases from a different perspective. I’m not only interested in standard of care and causation. I search to find anything that can help defend the case. Then, once there is a coherent, believable, accurate understanding of the issues and defense positions on them, I’m better able to help the attorney prepare the insured for deposition and/or trial testimony. Therefore, I try to help the insured become the best possible witness he/she can be.
